fostering self-determination in accordance with
Article 235 of the South African Constitution, we
empower individuals to reclaim their human rights,
practice sustainable living, and build resilient,
inclusive communities that honor diversity and

Self-determination - Article 235 of the South Africa Constitution

Article 235. The right of the South African people as a whole to self-determination, as manifested in this Constitution,
does not preclude, within the framework of this right, recognition of the notion of the right of self-determination of any
community sharing a common cultural and language heritage, within a territorial entity in the Republic or in any other
way, determined by national legislation.

Customary international law 232. Customary international law is law in the Republic unless it is inconsistent with the

Constitution or an Act of Parliament.

Application of international law 233. When interpreting any legislation, every court must prefer any reasonable
interpretation of the legislation that is consistent with international law over any alternative

interpretation that is inconsistent with international law

International law recognizes the right to self-determination as a fundamental principle, allowing peoples to freely
determine their political status and pursue their economic, social, and cultural development. This principle is enshrined
in key international legal instruments:

1. The United Nations Charter (1945): Article 1 of the UN Charter highlights self-determination as one of the purposes of
the UN, promoting friendly relations among nations based on respect for this right.

2. The International Covenant on Civil and Political Rights (ICCPR, 1966) and the International Covenant on Economic,
Social and Cultural Rights (ICESCR, 1966): Both covenants reaffirm the right to

self-determination in their Article 1, stating that "All peoples have the right to self-determination. By virtue of that right,
they freely determine their political status and freely pursue their economic, social and cultural development."

3. The Declaration on the Granting of Independence to Colonial Countries and Peoples (1960): This UN General
Assembly resolution explicitly emphasizes the right of colonial territories to self-determination, stating that "All peoples
have the right to self-determination" and that colonialism must be brought to an end.
